Ever since 9-11, "Indefinite Detention" has been an unofficial policy in the US to "deal with detention of persons the government suspects of involvement in terrorism". Until now, it's worked quite well. But without charging him and trying him he becomes a problem. He was actually released because it stopped any legal/supreme court investigation of the process of dealing with such suspects in the West Bank.
