NY Mets Stand Tall against Arab, Leftist Pressure

What does the New York Mets baseball team have to do with Arab or Leftist pressure?

I had no clue, till getting this from a reader:
The New York Mets will allow the Hebron Fund to host its annual dinner at a club in the team's stadium despite a protest.

Eleven organizations, including Jews Against the Occupation-NYC and the American-Arab Anti-Discrimination Committee, had asked the Mets to cancel the Nov. 21 event at Caesar's Club in Citi Field.

Shlomo Mostofsky, president of the The National Council of Young Israel, praised the Mets for honoring their commitment in a letter addressed to the club's governing body.

He called the dinner a "celebration of the human spirit," according to a Young Israel news release.

"The New York Mets organization is not facilitating a political event; rather it is enabling a salute to a group of men, women, and children whose determination and inner strength have allowed them to remain in their communities, despite desperate attempts by Israel's adversaries to drive them from their homes," Mostofsky wrote in a letter to Mets CEO Fred Wilpon; his son Jeff, the team's chief operating officer; and President Saul Katz. Obviously, this has all of those who despise a Jewish presence in Hebron in a tizzy.

While the NY Yankees may have won the World Series (which made me happy), I tip my hat to the NY Mets for standing up to Arab, Leftist and Anarchist pressure.

Are British Jews Jewish?

"The requirement that if a pupil is to qualify for admission his mother must be Jewish, whether by descent or conversion, is a test of ethnicity which contravenes the Race Relations Act,... [Whether the reasons were] benign or malignant, theological or supremacist makes it no less and no more unlawful."
British Court of Law in a landmark ruling this week on "Who is a Jew"

I don't know anything about British Law, but Shmuley Boteach (who lived in sunny England for many years) seems to feel that the law as it was decided the other day has some serious negative ramifications.

Shmuley basically understands it to mean that according to British law, a Jew is only a Jew if he is a practicing Jew, and a Jew is not a Jew if only his mother/parent is Jewish, and considering someone Jewish because of their mother/parent is illegal.

This ruling certainly fits in with certain non-Jewish understandings of Judaism which call it a religion. But basically, the British court has defined all secular Jews to be non Jews (and if I was a secular Jew I'd be outraged, but who knows if Brits get visibly excited about anything).

But, as we Jews know, Judaism is certainly not a religion in the non-Jewish sense, it is a nationality many of whose central laws are theological in nature.

My solution for this problem with British law is simple. All British Jews (religious and non-religious) leave stupid England and make Aliyah. It won't be the first time (the expulsion from England part that is).

Clarifications, News and Links: Monday 9-11 (dd--mm)

0. Political Cartoon from the Palestinian Authority newspaper, Al-Lakta, 8/Nov/09:

Title: "Jews Destroying the Arab Dream"

I guess subtlety isn't one of the finer points in Arabic, Anti-Semitic cartoons.

1. Clarification to yesterday's posting about the Congressional Bill, HR 3296 "Affordable Health Care for Americans Act" and its taxation for US citizens living outside the USA.

The bill in the House of Representatives was originally slated to include a tax of up to $1900 for US Citizens, yet non-USA residents -- however, due to lobbying efforts, including those from "Democrats Abroad", a provision was included, exempting Americans living abroad from payment of any penalty or additional taxes imposed by the bill. That's the good news.

The bad news is that current bills before the Senate, however, do not include such an exemption. "Democrats Abroad" is working with Senate staff to include in those bills the same or similar language as the exemption for Americans residing abroad passed by the House.

I would advise American Citizens who live abroad from the United States to continue to send emails and faxes as recommended yesterday. Since this is a bi-partisan issue, applicable to ALL US citizens living abroad from the United States, I wholeheartedly suggest you participate in this lobbying effort.

Thanks to Robert Checkoway, the International Vice Chair of Democrats Abroad, Joanne Yaron, Chair of Democrats Abroad-Israel, and the ACA for alerting us all to this crucial lobbying effort.

2. News Updates about the Ft. Hood shooting in Texas. When a person shouts "Allahu Akabar" and shoots at people, there's very little doubt that the shooter believes he is engaged in a holy mission of death. Praising Allah, while taking the lives of innocent people is clearly behavior of a radical Islamist, and I don't know why some are trying to mute the issue.

It didn't come as a surprise to me that ABC reported the following:

- U.S. intelligence agencies were aware months ago that Army Major Nidal Hasan was attempting to make contact with people associated with al Qaeda, two American officials briefed on classified material in the case told ABC News.

- In a blog posting early Monday titled "Nidal Hassan Did the Right Thing," Awlaki calls Hassan a "hero" and a "man of conscience who could not bear living the contradiction of being a Muslim and serving in an army that is fighting against his own people."

According to his site, Awlaki served as an imam in Denver, San Diego and Falls Church, Virginia.

- The Associated Press reported Sunday that Major Hasan attended the Falls Church mosque when Awlaki was there.

- The Telegraph of London reported that Awlaki had made contact with two of the 9/11 hijackers when he was in San Diego.

3. News: In a semi-dramatic announcement at the Muqata @ Ramalla, last week, PA President Mahmoud Abbas revealed that he would not be running for re-election. YNET reports that, "While Abbas' declaration was met with crowds pleading with him to reconsider during a Sunday visit to Bethlehem and Hebron, the Palestinian street seems mostly indifferent. "

The more dramatic issue was that the PA might simply declare their "statehood" as fact, making Israel, by default, a foreign occupier of a sovereign state.

Dan Izenberg at the Jerusalem Post writes a legal opinion on what would happen:
It is clear from the provisions of the 1995 Oslo Interim Agreement that the Palestinian Authority would be perpetrating a material breach of the treaty by declaring an independent state.

According to Article 23 of the internationally recognized accord, "neither side shall initiate or take any step that will change the status of the West Bank and the Gaza Strip pending the outcome of the permanent status negotiations."

Therefore, a unilateral declaration of independence by the PA would constitute a clear and serious violation of the agreement.

According to attorney Allen Baker, a former legal adviser to the Foreign Ministry, on the basis of that breach, Israel could declare the entire agreement void.

Israel could have declared the entire agreement void within days of the agreement's signing, since Fatah terrorists continued to murder Israelis, with the tacit support of Arafat. In 1996, when the Kotel tunnels were opened, PA policemen opened fire on IDF troops everywhere, and that could also have been reason enough to annul the agreement. Or the intifada in October 2000. Israel simply never misses an opportunity, to miss an opportunity, to declare the agreement null and void due to Palestinian Authority non-compliance.

4. Links: Are Israelis Rude? Israel has been improving daily over the years -- customer service is now a real concept, even among government offices.

Over at Mom in Israel's blog, a comment war is raging over Israeli behavior; rude, misunderstood, or simply a generalization?

What set it all off was this comment:

"We spent our sabbatical year in Israel in 07-08. It was a fabulous experience. I agree with most of the observations/comments above. For me, the most striking thing was the bad behaviour of the children AND the adults who had obviously been parented in a similar manner. Don’t get me wrong. My children also misbehave, but the difference is that, when they do, I notice, I care and I act. Many Israeli parents do not notice, care or act. They are raising another generation of rude, spoiled children. I had visited Israel 3 times before our sabbatical year and, of course, I noticed and experienced the rude behaviour of both adults and children. However, over the course of the year, this aspect of Israeli culture REALLY began to wear on me. It was embarrassing, as a Jew, to imagine what non-Jewish tourists thought of “us” as Jews. They are not just seeing rude Israelis, they are seeing rude Jews. Many of the Israelis that I spent time with while in Israel were also embarrassed by the behaviour of their fellow Israelis and their children. The difference, in almost every case, was that the people I spent time with – family and friends – had themselves lived in Canada or the US."

5. Clarification about yesterday's post on Democrats and how they voted on the resolution rejecting the Goldstone Report. While the resolution was sponsored by Republican Representative, Ileana Ros-Lehtinen (Florida), special mention should also go to Rep. Howard Berman (Democrat, California) (and/or members of his staff) -- he deserve a lot of credit for drafting the resolution and for rewriting the resolution to address Goldstone's specious response. (Thanks soccerdad)

This blog doesn't go out of its way to target Democrats or Republicans....the driving factor for this blog, is what is best for Israel. While I have a lot of respect and appreciation for the United States, my primary interest lies with Israel.

Liberal Democrats with Hawkish views on Israel are some of my good friends.

TAU Professors forbid "rightwing" student opinions

How typically Orwellian.

Proclaim you're all for free speech...as long as its the free speech you want to hear. Surprisingly, Haaretz reported this: (perhaps they didn't want to get scooped by the Jerusalem Post?)
Tel Aviv University students are hesitant to express their political views in class, lest lecturers perceived to have left-wing political views penalize them with lower grades, the head of TAU's Department of Curriculum and Instruction wrote in an internal memorandum last month. Prof. Nira Hativa's comment in the faculty memo ignited controversy among professors, with some declaring that her sentiments should not be made public.

Hativa wrote: "There are no small number of students of lecturers with left-wing views who complain bitterly that they are extremely offended by the presentation of materials that oppose their views, but are fearful of expressing contrary viewpoints in class, lest it harm their grades."

Faculty watchdog website, IsraCampus has the following to say about TAU:
There is no doubt that some departments at Tel Aviv University have a disproportionate number of academics with very harsh and strong words to say about and against Israel. TAU's faculty excel in signing petitions. One of the more benign was devoted to "Academic Freedom," where Israel was condemned for its system of "checkpoints, blockades, walls and fences [that] prevent thousands of students and teachers from leading a normal academic life" in the "occupied Palestinian territories."

Three out of the four organizers of the petition were from TAU. Furthermore all three of them were members of the Cohn Institute for the History and Philosophy of Science and Ideas. This single "institute" has all of 13 faculty and all but two of them signed this petition. Another more radical petition supporting Israelis who dodge military service garnered 9 of 13 of the members' signature. Diversity of ideology and thought is not something promoted at Tel Aviv University's Cohn Institute.

Broadening the examination of Tel Aviv University to include the Philosophy Department as a whole, whose radical Israel critique is led by Anat Matar and Anat Biletzky, will be part of this study. In addition attention will be placed on the TAU Political Science Department, whose Yoav Peled is an outspoken critic of Israel and signer of anti-Israel petitions. Peled is worth a special examination. He passes himself off as a mere critic of civil society in Israel but has claimed, "The obvious model for the transformation of the Israeli control system into a secular, democratic state is the transition experienced by South Africa." The Second Intifada, in which more than 950 Israeli civilians were killed, was an "armed rebellion." No human rights violations there. He calls Zionism a movement that was "from the 1880s to the birth of the Israeli state in 1948 was a variation of the European colonial movement." Peled also happens to be a leading member in Israel's communist party, HADASH. Peled is also a supporter of the "One-State Solution," in which Israel would cease to exist
Leftists academics dish out everything they want...from bashing the State of Israel, calling for its nullification, and demeaning the IDF soldiers who defend it. They get funding from the State of Israel in the name of free academic thought, yet TAU refuses to let anyone dare formulate and express an opinion to the right of their virulent own.

Are US Democrats Really Friends of Israel?

Of course they are.

But less than the Republicans, if we use the Goldstone Report as a yardstick.

Last week, resolution HR 867 was brought to the US House of Representatives;

"Calling on the President and the Secretary of State to oppose unequivocally any endorsement or further consideration of the "Report of the United Nations Fact Finding Mission on the Gaza Conflict" in multilateral fora."

We owe a big thank you to Republican Representative, Ileana Ros-Lehtinen (Florida) for sponsoring this resolution, the 202 other bi-partisan co-sponsors, and to congress in general for passing the resolution by 80% of the House.

The resolution passed overwhelmingly, which shows that Congress stands firmly behind Israel, and condemns the Goldstone report for the lopsided bias that it is.

Yet the story is behind the numbers -- those that voted against the resolution (thereby not unequivocally rejecting the Goldstone report), those that were present but lacked a moral backbone to vote either way (you have to wonder what they're doing in congress in the first place), and those not present all.

Democrats: 70% voted against the Goldstone report, while 30% voted in favor, couldn't make up their mind, or didn't show up.

Republicans: 93% voted against the Goldstone report, while only 7% voted in favor, couldn't make up their mind, or didn't show up.

This blog is avowedly non-partisan, yet Democrats need to answer why more than 4 times Democratic Congresspeople are lukewarm to Israel (at best) than the Republicans on this issue.

You don't have to be a rocket scientist to see the bias in Goldstone's report.

Health Care Bill Taxes American Abroad

As if the FBAR wasn't enough.

US President Obama's Universal Health Care program has already passed in the House of Representatives in Congress -- it only requires a majority in the Senate before this serious, nation-changing legislation becomes law.

Partisan politics aside, why would an American living outside the United States care?

The organization, American Citizens Abroad (ACA) has the reason; as an American citizen living outside the United States, you will be required to pay up to $1900 annually, even if you receive zero health benefits whatsoever.
Under Title 1, Subtitle D, “Shared Responsibility”, the Personal Responsibility Requirement currently states on page 28 that “Beginning in 2013, all U.S. citizens and legal residents” would be required to purchase coverage of one of the specified types of insurance coverage. This broad reference clearly includes U.S. citizens residing overseas. Yet citizens who are bona fide residents in foreign countries have health coverage plans valid in the country where they reside. If they subscribe to the U.S.-specific insurance outlined in the program – which they do not need and cannot use – they will be paying twice for health insurance. If they do not participate in the U.S. program, they will be subject to an excise tax to be levied on their IRS returns as defined in the bill on page 29.

The purpose of the excise tax is to encourage all Americans who benefit from the U.S. health program to participate in its financing. Americans residing overseas cannot benefit from the U.S. health system, so for them the excise tax is just that – a tax with no counter-part service. As per the September 22nd press release concerning the chairman’s markup, the maximum excise tax per family for non-participation, is $1,900, not a negligible amount.
This means: Even as an American living in Israel, paying monthly health care taxes in Israel, (under Israeli government mandated health care laws), you will also need to pay American Health care, even though you can get zero benefit from US Health care!

What can you do to help prevent this unfair tax? Immediately, (that means NOW) write to your congressperson in the Senate. The ACA makes our life easier as follows:

As one of your constituents who resides outside of the United States, I write you as my Senator to request that you alert Senator Baucus and the drafters of “America’s Healthy Future Act of 2009” concerning the urgent need for greater precision in the definition of those covered by the proposed legislation. In the version as released on September 16, 2009, there is wording which would inadvertently cause great hardship to American citizens living outside the United States. We hasten to bring this to your attention, so that it can be corrected early in the legislative process.

Overseas Americas should be exempted from the requirement to participate in the U.S. health plan and as a consequence, they should also be excluded to any right to claim a tax credit available for low income families in the United States under this health legislation.

Proposed solution:

A modest alteration in the present formulation would correct the legislation. Following is a suggested addition.:
“All U.S. citizens who meet the requirements of Sec. 911(d) (1)(A) or (B) of the Internal Revenue Code of 1986, without regard to the tax home requirement in Sec. 911(d)(1), are exempt from any mandate to purchase insurance in the United States and are not subject to the excise tax for non-participation in a U.S. health insurance plan.”

This modification would align the Senate bill to the "America’s Affordable Health Choices Act of 2009" (H.R. 3200) presented in the House of Representatives, which specifically exempts overseas Americans from a tax on not subscribing to a U.S. domestic health plan under Section 401 of the Act (which adds Section 59B of the Internal Revenue Code of 1986). America’s Affordable Health Choices Act of 2009 states under Part VIII – HEALTH RELATED TAXES
Subpart A -Tax on Individuals Without Acceptable Health Care Coverage
Section 59.B “Tax on Individuals Without Acceptable Health Coverage
(c) Exceptions:
(3) INDIVIDUALS RESIDING OUTSIDE UNITED STATES
Any qualified individual (as defined in section 911(d)) (and any qualifying child residing with such individual) shall be treated for purposes of this section as covered by acceptable coverage during the period described in subparagraph (A) or (B) of section 911(d)(1), whichever is applicable."

IDF Spokesman -- Blogger Press Conference

This evening at 9:30 PM, Lt. Col. Avital Leibovitch conducted a press conference for bloggers about today's IDF capture of an Iranian cargo ship, loaded with weapons on its way to Syria and Hezbollah.



IDF Spokesperson Lt. Co. Avital Leibovitch:

Late last night, IDF navy forces boarded an Iranian cargo ship. We asked the captain if we could check the containers of his ship and he agreed without a problem.

We checked the shipping containers and found they were filled with munitions, so we then directed the cargo vessel to accompany us to the port in Ashdod, Israel. The cargo vessel was intercepted by IDF naval forces about 100 nautical miles west of Israel

We have opened only 1/3 of the 40 containers so far (as of the press/blogger briefing at 9:30 PM)

We have found so far:

106mm rockets
107mm rockets
122 mm Katusha rockets
mortars
hand grenades

These munitions were packed in shipping containers, behind large bags of plastic polyethylene. In addition to the plastic material physically hiding the munitions, polyethylene prevents scanners from identifying munitions hidden behind them.

These munitions discovered so far were manufactured by China, Russia, and Spain, which goes against UN resolution 1747 - forbidding exports or commerce of weapons with Iran.

We saw on shipping documents that the vessel's port of origin is an Iranian port, and it's destination was Syria, for the weapons to get to Hezbollah.

Questions:

Jameel: Some of Israel's detractors claim that this was an act of piracy. What legal basis does the IDF in detaining this ship?

IDF Spox: This action was completely in accordance with international law. There is no legal problem to board and check the contents of a vessel in a country's surrounding area. No force was used whatsoever and the captain of the ship agreed to accompany IDF naval forces to the Ashdod port.

Question: Was this a routine mission or based on intelligence?

IDF Spox: This was a routine mission. The navy conducts checks like all the time.

IDF Spox: The amount of munitions seized is -- 10 times more than Karin A cargo boat which was illegally bringing munitions to the Palestinian Authority in Gaza in October 02. The Karin A has 50 tons of munitions aboard, while this boat last night had over 500 tons of munitions on board.

Question: Was this a 1 time success, or do ships like this transport weapons to Hezbollah all the time? Is this one boat captured out of five?

IDF Spox: We don't know how many other attempts or boats may have gotten through, but this is definitely part of a pattern to re-arm Hezbollah.

Question from David Abitbol/Jewlicious: What is the range of the rockets?

IDF Spox: More than 40 kilometers.

Question from David Abitbol/Jewlicious: While watching the video, some of the munitions looked brand new, while others looked a bit used. Why would Iran send anything less than brand new to Hezbollah?

IDF Spox: I was there today and saw all the munitions personally. They were all brand new. All of it, what has been opened so far.

Question from Prof. Richard Landes: What are the next moves for Israel in light of this success?
IDF Spox: That's more of a political question, one best addressed to Israel's government.

Here's the difference:

  • Yaakov Teitel will have his day in Israeli court and, if convicted, spend a good part of the remainder of his life behind bars.

  • Prime Minister Netanyahu isn't asking for Jewish terrorist Yaakov Teitel to be freed.

  • There are no Israeli security forces planning to capture Palestinians to trade for Yaakov Teitel's release.

  • The Israeli school system isn't teaching that Yaakov Teitel is a hero.

  • No summer camp sponsored by a leading Israeli political party is going to be named after Yaakov Teitel.

  • Yaakov Teitel's family isn't going to get a monthly stipend from the Government of Israel as a sign of thanks for his actions.
